Approval of Ordinance 09-2022 on Second & Final Reading regarding updates to the Special Events Ordinance.End

BACKGROUND:

 

At the June 7, 2022 Cocoa City Council meeting, City Council approved language revisions in the special events ordinance regarding approval by Council for special events that are gated and/or charge admission. Currently the ordinance reads that all special events that are gated and/or charge admission and all street closures must be approved by City Council. It was approved to change that to only include street closure approvals by City Council and all other event approvals by the City Manager. Highlights of all of the requested changes to the ordinance are listed below:

 

                     Addition of the Maintenance of Traffic (MOT) Plan requirement with special event permits that request a street closure. This allows staff to better prepare and plan for street closures and how surrounding traffic will be impacted.

                     Revising the language for gated and/or events that charge admission to be approved by the City Manager and not by City Council. City Council will continue to approve all street closures.

                     Police Special Detail deployment was revised to increase the number of officers required for events that range from 4-13 officers depending on the potential hazard to public safety the event may impose.

                     Fire Special Detail deployment was revised to increase the number of fire personnel required for events that range from 2-4 firefighters depending on the potential hazard to public safety the event may impose. Also, based on state regulations related to food vendors inspections, we have added information about the requirement for inspection of food vendors related to special events.

                     Language including that event permits may be suspended as well as revoked for a bona fide public emergency as well as the applicable code violations.

 

This is the first reading of the changes to the Special Events Ordinance.

Ordinance approved at the July 26, 2022 City Council meeting on first reading. Cocoa City Council approved at the June 7, 2022 the change in language regarding Council approval of gated and/or events that charge admission.
