body

BACKGROUND:

The City of Cocoa provides potable water service throughout Central Brevard County including within the jurisdictional limits of three cities:  Cape Canaveral; Cocoa Beach; and Rockledge.  Historically, the City of Cocoa has maintained long-term water service agreements with each of the three cities with a term of 30 years.  In 2020, the City of Cocoa renewed a water service agreement with the City of Cocoa Beach.  At that time, a new water service agreement was written for the purpose of standardizing the three water service agreements when the time came to renew the other agreements with Rockledge and Cape Canaveral. It is now time to renew a water service agreement with Rockledge under substantially similar terms to the City of Cocoa Beach agreement.  A new water service agreement with Cape Canaveral will likely follow later this year prior to expiration of their water service agreement.

On September 27, 1994, the City of Cocoa and Rockledge renewed the water franchise agreement establishing terms and conditions under which the City of Cocoa provides water service to customers within the jurisdictional limits of the City of Rockledge.  The current agreement expires on September 27, 2024.

The new Interlocal Agreement ith the City of Rockledge was prepared and reviewed by the City Attorney and Utilities Director.  It is substantially the same as the Cocoa Beach Agreement.  The new Interlocal Agreement was also approved by the Rockledge City Council.  Staff is recommending approval.  Upon approval and recordation of the new Interlocal Agreement, the 1994 agreement will terminate and the new Interlocal Agreement will take effect.

STRATEGIC PLAN CONNECTION:

To provide reliable and safe drinking water and fire hydrant service to all Cocoa water customers.

BUDGETARY IMPACT:

N/A.  Water rates are established for all customers by separate action of the Council.  Operational costs of the water utility are likewise handled by separate action of the Council.

PREVIOUS ACTION:
