BACKGROUND:
On April 3, 2023, Governor DeSantis signed House Bill 543 into law. This legislation became Ch. 2023-018, Laws of Florida, and in part requires each law enforcement agency in this state to have a written active assailant response policy by October 1, 2023. This policy is to be consistent with each agency’s response capabilities and include response procedures specifying command protocol and coordination with other law enforcement agencies in each geographic region. Each agency is to ensure that all sworn personnel have been trained on the agency’s existing active assailant response policy, and that sworn personnel are trained within 180 days (six months) after enacting a new or revised policy. Furthermore, each agency is to ensure that all sworn personnel receive annual training on the policy.
Budgets for FY24 have been finalized and are underway. However, the use of the Federal Forfeiture funds for the above Active Assailant training scenario, is permissible under the Guide to Equitable Sharing, page 14, section B.1.b. which states: “Law enforcement training and education-Training of investigators, prosecutors, and sworn and non-sworn law enforcement personnel in any area necessary to perform official law enforcement duties, such as canine handler, narcotics, defensive tactics, criminal justice, language, constitutional law, accounting/finance, or forensics-provided that the employees’ regular duties require knowledge of these topics. Examples include training and conference registration fees, tuition, speaker fees, or costs to produce training curricula.” As an allowable expense, and requires that the Chief of Police certify it as a valid expenditure.
The multi-colored blanks, 9mm marking rounds, and helmets are needed to conduct live/realistic training scenarios. With this training equipment, our officers will be immersed in a realistic scenario utilizing role players and training weapons that utilize blank cartridges that simulate gunfire. During this training, due to the projectiles, helmets are required to protect the officer's/role player’s eyes and faces.
Our current Active Assailant Instructors are Commander Anthony Marchica and Lieutenant Michael Dellatorre. Both have attended the FDLE Active Assailant Instructors course, and have assisted in conducting this instructor course for the Department and the AAT to School Resource Officers (SROs) through Eastern Florida State College (EFSC). The Police Department currently has General Order 0602 covering the Active Assailant Event. Further, we have adopted Eastern Florida State College’s Lesson Plan regarding Active Assailant training.
The Police Department would be looking to expend these funds from Ultimate Training Munitions using quote Q16989, and contract number 47QSWA19D00AS for purchase of required equipment.
