Approve Participation in a Multi-Year Piggy-Back Agreement with W&J Construction Corporation for Construction Manager at Risk Services Utilizing Brevard County’s Continuing Construction Manager (At Risk) Services, Contract # RFQ 6-22-05 Effective July 7, 2022 through 11/21/2025, subject to the City Manager and the City Attorney finalizing and approving the form of the contract; Authorize the City Manager to Execute the Piggyback Agreement, in a form acceptable to the City Attorney and any Amendments and Renewals Under the Existing Contract. Approve a Resolution Amending the FY23 Budget, BAF#23-115-A to Fund the Project and Grant the City Manager the Authority to Adjust Account Lines with the Schedule of Values. Authorize the City Manager to Approve a Task Order in a form acceptable to the City Attorney & Purchase Order to W&J Construction Corporation for the Guaranteed Maximum Price (GMP) of $1,889,004. Approve a Contingency Resolution Authorizing the City Manager to issue Owner Directed Change Orders not to exceed $80,000.

BACKGROUND:
Council directed Staff to design and construct certain improvements at Provost Park. These improvements are funded through a combination of FY21 Assigned Fund Balance and Unassigned Fund Balance.
Bid # B-23-21-COC for capital improvements at Provost and Don "Mo" Stradley Memorial Park was broadcast on March 31, 2023, Closed on May 4, 2023 with no bids.
On July 11, 2023 Council approved the Construction Manager at Risk (CMAR) approach. Staff contacted W&J Construction and requested a GMP for the following improvements at Provost Park:
• Demolition of softball field, and other elements
• Multipurpose field, field fencing, irrigation, conduit for future infrastructure
• Reconstruct 2 basketball courts & 2 pickleball courts from existing courts
• Perimeter black vinyl fencing and southern sidewalk
• Construct Parking Lot with related storm water and lighting
• New Scoreboard
On August 10, 2023 W&J Construction submitted the following GMP - $1,889,004. Public Works is requesting $80,000 in contingency for owner directed change orders that the City Manager will approve.
On August 22, 2023 during the Budget Workshop, Council approved the funding for this project, which is inclusive of ERP Funds, which will be replenished with FY23 Assigned Fund Balance. Additionally, City Council authorized the use of SLFRF monies previously assigned to Park Overruns to pay for Police and Other Departments FY24 Vehicle requests, freeing up the use of Unassigned Fund Balance for this park project. Correct general ledger coding is unknown until staff receives the schedule of values for this project. As a result, staff is also requesting approval for the City Manager to adjust the account line item budgets that is within the total established budget of $1,889,004.
