BACKGROUND:

The City of Cocoa provides potable water service throughout Central Brevard County including within the jurisdictional limits of three cities: Cape Canaveral; Cocoa Beach; and Rockledge. Historically, the City of Cocoa has maintained long-term water service agreements with each of the three cities with a term of 30 years. In 2020, the City of Cocoa renewed a water service agreement with the City of Cocoa Beach. At that time, a new water service agreement was written for the purpose of standardizing the three water service agreements when the time came to renew the other agreements with Rockledge and Cape Canaveral. In May 2024, Council approved a new water service agreement with the City of Rockledge. It is now time to renew a water service agreement with Cape Canaveral under substantially similar terms to the City of Cocoa Beach and the Rockledge agreement.

In 1994, the City of Cocoa and the City of Cape Canaveral renewed the water franchise agreement establishing terms and conditions under which the City of Cocoa provides water service to customers within the jurisdictional limits of the City of Cape Canaveral. The current agreement expired on May 11, 2024.

The new Interlocal Agreement for the City of Cape Canaveral was prepared and reviewed by the City Attorney and Utilities Director. It is substantially the same as the Cocoa Beach and the Rockledge Agreements. Staff is recommending approval.
