BACKGROUND:

The City has a Financial Operations Manual (FOM) that was adopted in 2010 and is a compilation of the City's financial policies and procedures. Within the FOM is the Fraud Policy Sec. 21.3 (which followed Florida statute sec 11.45) that was adopted via Resolution 2010-137. The State of Florida updated the Florida statutes to include waste and abuse as part of section 11.45, resulting in the need to update the City's internal policy. The policy has been updated and renamed to include the definition of waste and abuse in addition to fraud. It defines the employee, City Manager, City Attorney and City Council responsibilities when there is suspected fraud, waste or abuse and defines the possible outcomes of any investigation into suspected fraud waste or abuse as substantiated, unsubstantiated, unsolved or unfounded. It outlines the procedure for reporting fraud, waste or abuse and provides the procedure for reporting suspected fraud, waste or abuse. This policy must be followed by all City employees and sets the standard for vendors and others who conduct business with the City. Additionally, all employees are required to acknowledge this policy at the time of hire and annually thereafter. The Fraud, Waste or Abuse Policy is attached to this agenda item as Attachment A. A copy of the previously adopted Fraud Policy (Reso. 2010-137) is attached as Attachment B to this agenda item.
