BACKGROUND:

As part of section 2 (b), Art. VIII of the Florida Constitution, and Section 166.021, Florida Statutes, the City Council may exercise home rule powers to adopt and authorize various fee schedules related to the ability to perform certain municipal functions.

The City Council adopted Ordinance 13-2022 which repealed the previously existing schedule of fees and authorized the City Council to adopt new fees by way of Resolution.

Following the approval of Ordinance 13-2022, the City Council has enacted two resolutions to revise the City of Cocoa Planning and Zoning Fee Schedule. These updates addressed various application costs and established a mechanism for the City to pass through fees associated with third-party reviews.

The proposed resolution introduces a fee for the new Lot Split application process, by Ordinance 06-2024, effective June 4, 2024, as approved by the City Council. Additionally, it establishes a new fee for the Community Development District (CDD) review typically used in planned communities and large developments, per Florida Statute ?190.005. The review of a Community Development District (CDD) by legal staff involves a comprehensive examination of various aspects related to the establishment and operation of the district.

Staff recommends the follow fees be added for the new Lot Split Application and the CDD review fee:

Lot Split Residential (single-family)
$500+Ad Fees
Lot Split Multifamily and Non-residential
$1250+Ad Fees
Community Development District (CDD)
$15,000 or as provided in 190.005, F.S.
