BACKGROUND:
Emergency Ordinance No. 13-2020 Requiring Face Coverings.
On Wednesday, August 12, 2020 the City of Cocoa passed Emergency Ordinance No. 13-2020 requiring face coverings in places open to the public inside the City limits of Cocoa consistent with the Centers for Disease Control (CDC) and Florida Department of Health (FLDOH) guidelines to help slow the spread of the COVID-19 virus locally. The ordinance was extended by the Cocoa City Council on Wednesday, September 9, 2020 and again on Tuesday October 13, 2020. In accordance with the Ordinance, the City Council must review the action after 30 days or when action can be taken by City Council at the next regularly scheduled City Council meeting. The Ordinance shall remain in effect until terminated by the City Council.
While fines and penalties may not be collected under the City's Emergency Ordinance due to Governor Desantis's Executive Order No. 20-244, the City can continue to require face coverings under the Ordinance. At the time of writing this agenda item the COVID-19 cases continue to maintain a statewide daily case number of around 4,000 a day. The Center for Disease Control still encourages the use of face coverings to prevent the spread of COVID-19.
Staff is seeking City Council direction on Cocoa's Emergency Ordinance No. 13-2020 to continue requiring face coverings within the City limits.
