BACKGROUND:
In 2014 three (3) equalization pumps were purchased and installed during the original Biological Nutrient Removal Project (WS1222) at the Sellers Water Reclamation Facility.
In 2016 portions of the work that was performed during the original project were discovered to be defective. Due to the defects the original pumps have not been able to be operated and need to be replaced.
Staff, with the assistance of the City Attorney and special legal counsel, is currently pursuing legal action against the original contractor, Brandes Design Build. Due to the ongoing litigation, staff is requesting that the pumps be purchased as a sole source. This agenda item is only for the purchase of the pumps; installation will be performed by a separate contractor. Staff will come back to Council to request award of that work at a later date.
On May 25, 2021, City Council approved agenda item #21-372 for the purchase of these pumps. Inadvertently, staff stated the purchase would be through TSC-Jacobs. TSC-Jacobs is the authorized sales representative for the pump manufacturer and not a distributor or dealer; therefore the purchase will be with Trillium Pumps USA, Inc.
Staff recommends the approval of a sole source purchase with Trillium Pumps USA, Inc. in an amount not to exceed $88,965.
