BACKGROUND:

At the December 14, 2021 Council meeting, Council members approved extending the expiration date of the expanded outdoor dining options for local restaurants currently approved for the temporary provision to August 9, 2022.

During the pandemic, the City allowed for outdoor dining in an effort to support the local restaurant industry. Several establishments took advantage of this opportunity.

Currently, the following establishments have applied for and were approved for the temporary expanded outdoor seating areas:
* Beef O' Brady's - private area only utilized; no public or private parking areas used
* Ossorio Bakery & Caf? - public sidewalk area only
* Jerk Flavas Jamaican Restaurant - private area only and no public or private parking areas used
* Village Idiot Pub - approved 4 public parking spaces but currently utilizing only 3
* Pub Americana - approved 3 public parking spaces
* Dog and Bone - approved limited use of the gazebo in Myrt Tharpe Square - no public or private parking areas used

Staff is requesting Council direction regarding Resolution 2021-13 that is set to expire on August 9, 2022 with the following options:
1. Allow the temporary provision to expire on August 9, 2022.
2. Authorize Staff to make the Resolution into a Sidewalk Caf? Ordinance to include the use of public parking spaces, sidewalk public spaces or non-sidewalk public spaces.

If Option #1 is selected, Staff will provide notice to all approved establishments to remove all seating and clean/pressure wash the areas prior to August 31, 2022.
