BACKGROUND:

The City has a Florida Department of Environmental Protection (FDEP) Phase II Municipal Separate Storm Sewer System (MS4) National Pollutant Discharge Elimination System (NPDES) Permit. Coverage under the Phase II MS4 Generic Permit allows our MS4 to discharge stormwater providing implementation of the Stormwater Management Program (SWMP).

Elements of the SWMP include stormwater education and public outreach efforts. On November 1, 2011, the city entered into an Interlocal Agreement with Brevard County for the performance of the permit required stormwater education and public outreach activities. The Agreement was subsequently amended on December 11, 2012, and October 10, 2017. This is the third amendment to the Agreement and the budgetary impact will be realized in FY2023 and subsequent fiscal years for the duration of the Agreement.


STRATEGIC PLAN CONNECTION:

GOAL 6.1: The City shall ensure the provision of a stormwater management system of appropriate capacity and functionality to protect public health and safety, fulfill requirements of the National Pollutant Discharge Elimination System (NPDES) and Total Maximum Daily Loads (TMDL's).
