BACKGROUND:
The City is authorized by law to establish fee schedules for planning and zoning related applications. Appendix A, Zoning, Article XX of the Zoning Ordinance of the City of Cocoa currently provides for a schedule of fees to be paid to the City upon receipt of planning and zoning related applications, which has not been updated since 2003. During the 2023 Budget Hearings, City Council has expressed its support to update the fee schedule in order to assist the City in defraying a portion of the costs and administrative expenses incurred by the City in the administration and enforcement of planning and zoning regulations.
The proposed ordinance would repeal the existing planning and zoning application fees in Article XX of the Zoning Ordinance of the City and provide that future planning and zoning application fees will be adopted by resolution, which is consistent with the manner and procedure used by the City Council to adopt numerous other types of fees and fee schedules. Future adoption of fees by resolution allows the City to amend fee schedules more efficiently and with less cost to the City.
